The 2008 Iraqi NGO law has been passed by the Shoura Council and is currently awaiting Cabinet approval. Iraqi NGOs and civil society activists are concerned about certain aspects of this law, which could have serious implications for the future independence of Iraqi civil society and for international NGOs working in the Iraqi context. The lack of consultation over the new draft law that is currently going through Iraqi parliament, and seeks to regulate the work of NGOs, raises the concerns that the Iraqi government is seeking to control the NGO's activities, rather than to support the development of an autonomous and vibrant civil society.
A civil society can only work in an environment free of unnecessary government interference. Especially concerning is the provision within the draft law that "any donations from inside or outside Iraq must first be approved by the government and all donors need to notify the government prior to making any funds available to NGOs.”
In addition to issues regarding the legislation itself, NGOs have continuing concerns about the registration process in Iraq, which is time consuming, onerous and often lacks transparency and consistency. The current office for assisting NGOs (NAO) location is inside the Green Zone in Iraq, which has exacerbated the NGO's ability to access their offices. Furthermore, electronic communication is problematic due to the office's limited capacity (staffing levels were reduced by 50% in mid-2008).
The new draft law requires very unrealistic measures and conditions from NGOs to be able to register and gives license from the office of the prime minster to the minster of civil society to cancel the registration of any organization without any court order, a measure that would directly challenge the rule of law. In this way, many civil society organizations will lose their independence and privacy, contradicting the soul idea of the non-profitable and voluntary principles which they are based on.
We ask the government and parliament to allow all Iraqi NGOs to take part in the ongoing discussions on the law, to listen, and to study their demands and opinions, and not present a law based on government views alone.
We believe in working together with the Iraqi government in building democracy and a new Iraq, ruled by the state of law. Therefore, creating a NGO law without the main benefiters’ ability to contribute will raise concerns about the future independence of civil society. We kindly ask your support for our appeal to start a new drafting process for the NGO law in Iraq, in which wider consultation with Civil Society takes place before the legislation is endorsed. We send this call with our concerns for a free, democratic Iraqi civil society, represented in our signature, hoping that we can build this new Iraq together, for the welfare of the Iraqi people.

أن مسودة قانون منظمات المجتمع المدني لعام 2008 تم رفعها من مجلس الشورى إلى البرلمان العراقي من اجل الموافقة عليها , وتتضمن في محتواها عدة من المواد التي تثير قلق المنظمات غير حكومية في العراق والمنظمات الدولية العاملة في العراق لما تحتويه من أثار على استقلالية عمل هذه المؤسسات , أن عدم استشارة المنظمات المعنية بالقانون قبل تقديم مسودتها للبرلمان تثير المخاوف من محاولات لتحديد استقلالية هذه المنظمات وهيمنة الحكومة على عمل المنظمات غير الحكومية بدلا من دعمها لناء مجتمع مدني قوي وفعال ,أن ناشطي المجتمع المدني قلقون من صدور قانون يمنح الحكومة القدرة على مراقبة وتسير كيفية حصول هذه المنظمات على تمويل والدعم , والحاجة إلى قيام المانحين بإبلاغ الجهات الحكومية قبل تقديم الدعم والتمويل للمنظمات يثير مخاوف الناشطين من سياحية للتحكم والسيطرة بالمجتمع المدني العراقي في المستقبل
بالإضافة إلى كون عملية تسجيل المنظمات في العراق لا تزال تفتقر للشفافية والاستمرارية , أذا لا يزال موقع مكتب تسجيل المنظمات داخل المنطقة الخضراء في بغداد يجعل من الصعب لكثير من المنظمات الوصول له لإكمال عملية التسجيل بالإضافة لافتقاره للتوفير خدمة تواصل الكترونية بسب تخفيض العاملين فيه إلى النصف في 2008
اشترط مشروع القانون الجديد عدداً من الشروط الثقيلة منها شهادات حسن السلوك لمؤسسيها وموافقات من قبل الأمانة العامة لمجلس الوزراء فضلاُ عن أمور أخرى تتعارض مع صفتها الطوعية غير الربحية.. كما سمح لمجلس الوزراء بناء على طلب من وزير الدولة لشؤون المجتمع المدني ، إلغاء الترخيص لهذه المنظمة أو تلك.. بدون قرار صادر من القضاء.. أننا نطالب من الحكومة والبرلمان بالسماح لكل المنظمات غير الحكومية بالمشاركة في المناقشات الجارية حول هذا القانون، وبالاستماع لمطالبها وآرائها وأخذها بالاعتبار . يجب ألا تتم المصادقة على قانون مبني على آراء الحكومة فقط
أن إيماننا بأهمية مشاركة المجتمع المدني مع الحكومة في بناء العراق الديمقراطي الجديد يتطلب سماع أراء المستفادين من القانون قبل تصديقه
